Ask, don’t tell…where does discrimination start and stop…is the common term for the policy about homosexuality in the U.S. military mandated by federal law “Title 10 of the United States Code.” Unless one of the exceptions from Title 10 of the United States Code 10 U.S.C. applies, the policy prohibits anyone who “demonstrate(s) a propensity or intent to engage in homosexual acts” from serving in the “Military of the United States” because “it would create an unacceptable risk to the high standards of morale, good order and discipline, and unit cohesion that are the essence of military capability.” The act prohibits any Homosexual person from disclosing his or her “Sexual orientation”or from speaking about any homosexual relationships, including marriages or other familial attributes, while serving in the United States armed forces. The “don’t ask” part of the policy indicates that superiors should not initiate investigation of a service members orientation in the absence of disallowed behaviors, though mere suspicion of homosexual behavior can cause an investigation.
When does discrimination begin and who will we discriminate against next? The don’t ask don’t tell policy was introduced as a compromise measure in 1993 and approved by then President Bill Clinton who, while campaigning for the Presidency, had promised to allow all citizens, regardless of sexual orientation, to serve openly in the military, a departure from the then complete ban on those who are not. The actual policy was crafted by and was maintained by Clinton. Polls have shown that a large majority of the American public favors allowing gay and lesbian people to serve openly in the U.S. military. A national poll conducted in May 2005 by the Boston Globe, 75% of Americans – including 80% of Democrats, 75% of independents, and 66% of conservatives – said that openly gay people should be allowed to serve in the military.

While serving in the U. S. Army for 22 years I found the issues that created the greatest degree of problems in the military was adultery, fornication, infidelity other than drunkenness. During this time, as I worked my way from Private to Master Sergeant, not once did I encounter and issue where it required disciplinary action because two individuals of the same sex were engaged in homosexual activity. Yet a week did not pass that I did not find it necessary to bring a soldier to the commander for one or the other reasons as stated above. If we are to be discriminatory to a certain group of individuals should we not also remove soldiers from the military for other infractions “because it would create an unacceptable risk to the high standards of morale, good order and discipline, and unit cohesion that are the essence of military capability?” Up until 1993 homosexuality was banned completely and yet the other infractions were acceptable. This article is not about what is morally correct or incorrect,but it is about who we should discriminate against. Hitler chose to discriminate against the Jewish people and in our own history we have discriminated against not only the African Americans, but we have read about the Irish, the Catholic, the Jewish, the Japanese and the American Indian. We have written laws protecting the rights of all people, yet again we are focusing on another group. If a Government wants to be judgmental and replace the will of the people over the will of God by selecting one group should they not also read the Bible concerning adultery, fortification, infidelity, and drunkenness?
